Terms and Conditions
These Terms and Conditions (“Terms”) govern your use of the PICS Volunteer Management System (“System”) operated by Progressive Intercultural Community Services Society (“PICS,” “we,” “us,” or “our”). By creating an account or using the System, you agree to these Terms. If you do not agree, you must not use the System.
1. Use of the System
The System is provided to support volunteer and program registration, application management, and related services offered by PICS. You may use the System only for lawful purposes and in accordance with these Terms and any instructions we provide.
2. Account and Security
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your password and for all activity under your account. You must notify us promptly of any unauthorized use of your account or any other breach of security.
3. Acceptable Use
You agree not to:
- Use the System in any way that violates applicable laws or regulations.
- Impersonate any person or entity or misrepresent your affiliation.
- Upload or transmit any content that is defamatory, offensive, or infringes the rights of others.
- Attempt to gain unauthorized access to the System, other accounts, or our networks or systems.
- Interfere with or disrupt the operation of the System or the servers or networks connected to it.
- Use automated means (e.g., scrapers, bots) to access or collect data from the System without our prior written consent.
We may suspend or terminate your access if we reasonably believe you have violated these Terms or applicable law.
4. Applications and Content
You are responsible for the accuracy of the information you submit through the System. Submission of an application does not guarantee acceptance into any program. We reserve the right to refuse or revoke participation in accordance with our program policies. Documents and signatures you provide may be retained and used as described in our Privacy Policy.
5. Intellectual Property
The System, including its design, text, graphics, logos, and software, is owned by PICS or its licensors and is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from the System or its content except as necessary for your permitted use of the service.
6. Disclaimer of Warranties
The System is provided “as is” and “as available.” To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the System will be uninterrupted, error-free, or free of harmful components.
7. Limitation of Liability
To the maximum extent permitted by applicable law, PICS and its directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from or related to your use or inability to use the System. Our total liability for any claims arising from these Terms or your use of the System shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or one hundred Canadian dollars (CAD $100), whichever is greater. Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions, our liability will be limited to the fullest extent permitted by law.
8. Indemnification
You agree to indemnify and hold harmless PICS and its directors, officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the System, your violation of these Terms, or your violation of any rights of another.
9. Termination
We may suspend or terminate your access to the System at any time, with or without cause or notice. Upon termination, your right to use the System ceases immediately. Provisions that by their nature should survive (including disclaimers, limitation of liability, and indemnification) will survive termination.
10. Governing Law
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising from these Terms or the System shall be subject to the exclusive jurisdiction of the courts of British Columbia.
11. Changes
We may modify these Terms from time to time. We will post the updated Terms on this page and update the “Last updated” date. Your continued use of the System after changes are posted constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the System.
